General Terms and Conditions Schladming-Dachstein Card

The Schladming-Dachstein Card entitles Guests of the Schladming-Dachstein Region, who are staying

during Sommer-card season at a Schladming-Dachstein Card host business and who have registered by

means of the official Guest registration form, to take advantage of many bonus services as well as free

admission to many holiday attractions, including summer lifts, swimming pools and museums as well as

use of participating public transportation in the region and an exciting family program.

The purchase, issuance and utilization of the Schladming-Dachstein Card – insofar as not stipulated

otherwise – is subject exclusively to the following Terms & Conditions (hereinafter referred to as: Terms).

To facilitate comprehension, these Terms avoid gender-specific formulations to the greatest extent

possible. Insofar as any gender-specific terminology happens to be used, the intent is that this applies to

all genders.

These Terms apply to the contractual relationship between the operators of the Schladming-Dachstein Card and Schladming-Dachstein Card holders and – insofar as nothing is stipulated to the contrary below – represent the exclusive legal foundation for issuance and utilization of the Schladming-Dachstein Card. Divergent provisions are not recognized by the operators of the Schladming-Dachstein Card and may not, therefore, constitute part of the contract. The conclusion of an accommodation agreement with a host Schladming-Dachstein Card business (refer to website) entitles the contractual partner and their travel companions (Guest) to avail themselves of

the Schladming-Dachstein Card. (The contractual relationship between the Guest and the Schladming-Dachstein Card host – with the exception of provisions pertaining specifically to the Schladming-Dachstein Card – is unaffected by the Terms at hand.)

A requirement for issuance of the Schladming-Dachstein Card is that the Guest – in accordance with official registration regulations – has truthfully reported their personal data to the host Schladming-Dachstein Card business.

Regardless of the length of stay, the Schladming-Dachstein Card host is required to draw the Guest’s attention to the Schladming-Dachstein Card. The Schladming-Dachstein Card host will issue the Guest with a physical or digital Schladming-Dachstein Card. The physical Schladming-Dachstein Card only becomes valid subsequent to the Guest having signed the back of the card. The digital Schladming-Dachstein Card is valid as soon as it has been activated by means of the Schladming-Dachstein Card app (hereinafter referred to as: app) on the Guest’s smart phone. In order for the digital card to be issued (without a physical card), the Guest must provide the Schladming-Dachstein Card host with an email address to which the Schladming-Dachstein Card host can then send a link for the digital card.

The Guest is likewise entitled to install the app on their (mobile) device, then use the scan function to convert and subsequently use the physical card as a digital Schladming-Dachstein Card.

The Schladming-Dachstein Card may only be used for utilization of Schladming-Dachstein Card services by that person whose name and identification number is given on the card (the legitimate holder). With respect to the digital Schladming-Dachstein Card, it is possible to store the cards of several people on the same end device. However, each respective digital Schladming-Dachstein Card may only be utilized by the legitimate holder in question.

The Schladming-Dachstein Card is nontransferable and is not available for purchase on the open market (only as a season ticket).

The general validity period of the Schladming-Dachstein Card extends from 14 May until 2 November 2026.

The specific validity of a Schladming-Dachstein Card is restricted to the dates of the stay stipulated in the accommodation agreement entered into between the Guest and the Schladming-Dachstein Card host in question. Validity begins at 1 PM on arrival day, while the card remains valid for all of the remaining days including departure day.

The Schladming-Dachstein Card entitles the holder to utilize specified Schladming-Dachstein Card services according to the Schladming-Dachstein Card conditions as detailed. The specified Schladming-Dachstein Card services as well as the detailed Schladming-Dachstein Card conditions may be consulted at sommercard.info - this information is nonbinding. With the exception of the specific conditions, the respective tariff conditions of the Schladming-Dachstein Card service provider in question will apply.

When utilizing Schladming-Dachstein Card services, the respective general terms of carriage and business, access restrictions, capacity restrictions and hours of operation of the Schladming-Dachstein Card partner business will apply. Furthermore, utilization of Schladming-Dachstein Card services may be adversely affected by additional waiting periods or cancellations due to weather, seasonal or miscellaneous operational reasons. Liability on the part of the Schladming-Dachstein Card operator for such limitations of service is excluded.

In order to utilize a specific Schladming-Dachstein Card service, the physical or digital Schladming-Dachstein Card must be presented to the Schladming-Dachstein Card service provider whose Schladming-Dachstein Card services are about to be utilized, prior to concluding the contract entitling the cardholder to utilization of said Schladming-Dachstein Card services. The Schladming-Dachstein Card service provider is entitled to check the validity of the Schladming-Dachstein Card by means of an electronic verification device, visual inspection etc. If the Schladming-Dachstein Card service provider has any doubts about the validity of the Schladming-Dachstein Card or the holder’s entitlement to use the Schladming-Dachstein Card in question, the provider may demand presentation of photo identification as proof. If the Schladming-Dachstein Card is not presented, if it is not or no longer valid, or if the holder refuses to show it, the Schladming-Dachstein Card service provider is entitled to deny conclusion of a contract for the Schladming-Dachstein Card service in question according to the conditions originally associated with the Schladming-Dachstein Card.

The Schladming-Dachstein Card is nontransferable. The legitimate holder must ensure that the Schladming-Dachstein Card is not misused. Misuse includes in particular the illegitimate utilization of Schladming-Dachstein Card services under Schladming-Dachstein Card-specific conditions, duplication of the Schladming-Dachstein Card or use of the Schladming-Dachstein Card by third-parties. The at-tempt to transfer a Schladming-Dachstein Card to a different person constitutes misuse per se. In the event of misuse, loss, theft or other misplacement of the Schladming-Dachstein Card, the legitimate holder must notify the Schladming-Dachstein Card operator by telephone or email or the Schladming-Dachstein Card host without delay. The Schladming-Dachstein Card operator is not liable for the consequences of damages due either to complete failure or culpable delay in notifying the Schladming-Dachstein Card

operator about the misuse, loss, theft or other misplacement of the Schladming-Dachstein Card – subject to Pt. 8. of these Terms. Misuse will be penalized by confiscation without replacement of the Schladming-Dachstein Card and a fine of at least 70.00 €, or by official complaint lodged with the appropriate authorities.

With respect to loss, theft or other misplacement of the physical Schladming-Dachstein Card, the legitimate holder has the right to issuance of a new Schladming-Dachstein Card.

The holder of the Schladming-Dachstein Card is aware that the sole responsibility of the operator of the Schladming-Dachstein Card is for processing procedures between the legitimate holder and the Schladming-Dachstein Card service providers as well as Schladming-Dachstein Card hosts. The legitimate holders relinquish any potential guarantee or damage claims against the operators, regardless of whether the service provider or Schladming-Dachstein Card host is accused of a negligent breach or not. Liability on the part of the operator for damages due to slight negligence with respect to breaches of secondary obligations is excluded. In the event of negligent breaches with respect to primary obligations, the operator is not liable for damages the cause of which, by dint of their general nature, appear completely incommensurate with such damages, or for damages which are merely the result of an extraordi-nary

chain of circumstances. Liability on the part of the operator for premeditation, gross negligence as well as damages resulting from culpable injury to life, body or health of people shall remain unaffected by the aforementioned provisions.

The operator is not the contractual partner of the legitimate holder when utilizing Schladming-Dachstein Card services. That said, the operator is not liable with respect to any claims deriving from the contractual relationship between the legitimate holder and the Schladming-Dachstein Card service provider in question. In particular, the operator is not liable for denied, non-provided or inadequate (Schladming-Dachstein Card-)services rendered by a Schladming-Dachstein Card service provider, for damages resulting from the legitimate holder (or his/her companions) utilizing Schladming-Dachstein Card services, nor for those services listed as Schladming-Dachstein Card services under

schladming-dachstein.at/de/Sommer/Sommercard#Sommercard-Attraktionen or in the Schladming-Dachstein Card brochure not being offered by the service providers in accordance with the described Schladming-Dachstein Card conditions.

The safeguarding of personal privacy and personally identifiable data of the Schladming-Dachstein Card user is a special priority of the operator. Consequently, personally identifiable data is processed exclusively on the foundation of statutory provi-sions (Regulation [EU] 2016/679 for the protection of natural persons pertinent to the processing of personally identifiable data, free movement of data, and repeal of directive 95/46/EEC [GDPR], Data Privacy Act 2018 [“DSG 2018”] and the Telecommunication Act 2003 [“TKG 2003”]).

Consent to these Terms simultaneously confirms awareness of the Data Privacy Policy.

Amendments to the Terms come into immediate effect. The exception to this are Schladming-Dachstein Cards which are valid at the point in time when the amendment comes into effect. These continue to be subject to – with the following exceptions – the Terms in their most recent valid version prior to purchase of the Schladming-Dachstein Card.

The operator may undertake minimal, objectively justifiable amendments to these Terms consistent with § 6 (2) (3) KSchG unilaterally at any time. These amendments may include, in particular: extension of the validity period, editorial adaptations and stylistic changes. Schladming-Dachstein Card users will be provided notification of unilateral amendments to these Terms at the Internet address https://www.schladming-dachstein.at/en/footer/imprint and potentially also by email.

Should individual provisions of these Terms – including this particular provision – be declared null or void, either completely or in part, or if the agreement evinces an unforeseen loophole, this shall in no way affect the validity of the remaining provisions. In place of a voided or absent provision, insofar as no compelling legal regulations demand the contrary, this agreement will be amended by means of a provision which most closely approximates the commercial and contextual purposes of the original provision in question.

Insofar as no compelling statutory regulations demand the contrary, the applicability of Austrian substantive law under exclusion of international civil law as well as the UN Sales Convention shall be stipulated.

Insofar as no compelling statutory regulations demand the contrary, the international jurisdiction of the Austrian courts as well as the competent courts – at the point in time when suit was brought – with local jurisdiction over the seat of Schladming-Dachstein Tourismus GmbH shall be stipulated.

Offshoots of the Schladming-Dachstein Card for guests, there are various other cards which are valid for the entire Schladming-Dachstein Card season: the Vermietercard, Freizeitcard, employee- and benefit cards. These passes deviate in their included services and specific conditions from those of the Schladming-Dachstein Card for guests. The aforementioned terms are, however, applicable to all seasonal cards with the exception of the validity period and purchase conditions.

General Terms and Conditions of Ticket Sales

Entrance ticket according to the price list. No money will be refunded for redeemed cards. It is also not possible to return tickets after the event. The ticket may not be resold at a higher price. By purchasing the card, the visitor submits to the house rules. Admission ticket only valid with a valid QR code. Abuse will be punished. Changes and copies of the admission ticket are prohibited. In the event of altered or misused tickets, the organizer expressly reserves the right to deny the owners access to the event. The organizer bears no responsibility for any additional costs or inconvenience caused. The organizer reserves the right to postpone the event. If an event is canceled, the card can be reclaimed within six months.

Claims for damages of any kind against the organizer are excluded unless the organizer, his legal representative or his vicarious agent acted intentionally or with gross negligence and no essential contractual obligations were violated. There is no right of withdrawal when purchasing tickets for a specific event.

By purchasing the card, I agree that pictures I have taken may be used for advertising purposes. In the case of a TV broadcast, the card holder gives the broadcasting TV company his express consent that the recordings (images, films, TV) he made during or in connection with the event may be used without compensation as part of the usual evaluation. The organizer is not liable for injuries and accidents! Subject to program changes.

The visitor is advised that there is a risk of hearing loss and damage to health during events, particularly due to the volume, especially for children and people with hearing sensitivity.

Terms and Conditions of Ramsauer Verkehrsbetriebe GmbH

The Ramsauer Verkehrsbetriebe GmbH (abbr.„RVB“) operates a cross-country network (abbr. LN) of approx. 220 km classic- / skating- / sport-as well as illuminated night trails and a children‘s cross-country skiing park. RVB also operates a groomed toboggan trail, winter hiking trails and owns a snow-factoring system.

I. Cross-country skiing network (LN)

1. Only persons who are holders of a valid cross-country ski trail ticket (“Loipi”) are permitted to use the LN.

2. The valid ticket entitles the holder to use all the operating groomed trails within the period of validity according to the tariff conditions and this terms and conditions. The ticket is not transferable

Ticket purchase in advance: Tickets (cardboard card) are sold only in advance at authorized booking offices (Dachsteinbad, Ramsau information office, sports shops, tourism businesses, hotels and private tenants). The ticket shows the name and date of birth of the holder. Those tickets grant several discounts.

4. Ticket purchase on the trail: If you buy a cross-country ski ticket after you have entered the trail, or at a checkpoint along the trail, no discounts (e.g. WinterCard discount) will be granted. The cross-country ticket has to be carried along and presented by request. There are supervisors, appointed by RVB, who are entitled to check the validity of the tickets. If no valid cross-country ski ticket can be presented, further use of the LN is prohibited and we reserve the right to take legal action against the offender to issue appropriate cease and desist orders or a trail replacement fee in the amount of €161 will be levied.

5. Depending on snow conditions, the LN is available during the winter season (December to April). For safety reasons, the use of the LN is only permitted during daylight. The night trail is also available from 5:00 p.m. to 9:00 p.m.

6. If the LN cannot be used at short notice (e.g. weather conditions, avalanche danger, early departure, illness, accident, etc.), this fact does not justify a claim for reimbursement or an extension of the period of validity. This also applies to spatially limited or a temporary closure due to a sports event. If the card holder is not able to use the ticket because of illness or an accident, a multi-day / seasonal cross-country ski ticket can be deposited in the RVB office and a partial reimbursement (depending on price and duration of use) can be paid. A medical certificate is necessary to prove the submission. 100% until the end of December, 50% until the end of January, 20% until the end of February, after which there is no repayment.

7. The rules of conduct published by the International Ski Federation (FIS) apply to the entire network of crosscountry ski trails (available at https://dapi.oesv.at/v2/documents/download/de-de/fis-verendungregel). 8. Data protection: With the purchase of the “Loipi”, the holder agrees - within the framework of the data protection agreement - that the personal data collected in the process can be stored and processed electronically, insofar as this is necessary to avoid improper use or to process the contract.

II. Tobbogan and winter hiking trails (abbr.SWW)

1. The use of the SWW, groomed by the RVB, is for free, except for riders. The user accepts these terms and conditions explicitly. Use is only permitted for walking or pushing / pulling small sledges, strollers, children‘s sports equipment and similar gadgets. The use of motor vehicles of any kind is expressly prohibited.

2. Only on specially marked toboggan trails it is allowed to ride with fatbikes and animals. The rider has to have a valid cross-country ski trail ticket = fatbike ticket (FT) or a rider ticket (RT). The FT & RT corresponds to the Loipi and applies to the rights and obligations associated with the acquisition of the FT & RT, under the provisions of number I. points 1., 2., 3., 4., 5., 6.,8. and 9. (above), in each case related to the use of the toboggan runs with fatbikes and riding animals. Please note, fatbikes and riding animals on tobbogan trails § 79 StVO is applied.

III. Terms and Conditions:

1. Mostly agricultural areas and forestry land are made available for LN and SWW. The owners of these areas have graciously agreed to responsible and environmental external use. Please note the fact, that only marked or groomed areas (cross-country trails, paths) may be used; No dogs are permitted on the LN; Waste has to be disposed at designated locations; Violations of the terms of use can result in administrative penalties and / or disruption of property rights.

2. The “RamsauerLeben” season ticket entitles the holder to ride on the bus “public transport RVB” for free only in combination with a cross-country skiing equipment.

3. Except for personal injury, the RVB is only liable for damage caused by it (or third parties attributable to it) in the event of grossly negligent or willful behavior.
